PROPOSED AMENDMENT No.194 TO LOCAL PLANNING SCHEME No.17 - TO MODIFY SPECIAL USE ZONE No.24 BY REMOVING THE R20 DENSITY RESTRICTION ON LAND THAT IS NO LONGER AFFECTED BY AIRCRAFT NOISE WITHIN ROSEHILL WATERS ESTATE - MULTIPLE PROPERTIES IN SOUTH GUILDFORD 

The City of Swan Council resolved to initiate proposed Amendment No.194 to Local Planning Scheme No.17 to remove the R20 density restriction on land that is no longer affected by aircraft noise within Rosehill Waters Estate. 

At the time the Rosehill Waters Estate was first zoned for residential development in 2016, the land was entirely affected by aircraft noise (20-25 ANEF) and so residential development was restricted to a maximum density of R20 in accordance with State Planning Policy 5.1 Land Use Planning in the Vicinity of Perth Airport. 

Perth Airport has since revised its Australian Noise Exposure Forecast (ANEF) contours based on the Perth Airport Master Plan 2020, and portions of Rosehill Waters Estate are no longer affected by the 20-25 ANEF.  This means the restriction on residential density to R20 is no longer necessary for land that is not affected by the 20-25 ANEF. 

To reflect this change, Amendment No.194 proposes to amend Condition No.2 for Special Use Zone No.24 (Rosehill Waters Estate) in Local Planning Scheme No.17 as follows:

"Residential development shall be at a maximum density of R20, unless where land is not affected by ANEF contours, density  shall be in accordance with the Rosehill Waters Structure Plan". 

Amendment No.194 will not in itself change the density of development within the Rosehill Waters Estate.  Instead, Amendment No.194 will facilitate the implementation of the densities set out in the Rosehill Waters Structure Plan that applies to the land.
